This Privacy Notice contains important information on the personal information we collect about participants in the Mediation Voucher Scheme, what we do with that information, and who the information might be shared with.
We won’t disclose your information to anyone, other than as set out in this Privacy Notice and any applicable terms and conditions.
Mediation Voucher Recipients’ Information
If a mediator makes an application for you to receive a mediation voucher (i.e., a contribution towards your mediation costs as part of the Mediation Voucher Scheme) the FMC will collect information about you, in order to administer the voucher scheme.
This information will include your name, and may include contact details if your consent to participating in the scheme is provided via e-mail. If you receive a voucher, the FMC will also hold data about the mediation via your mediator.
If you choose to complete the client questionnaire, the FMC will also hold sensitive personal data about you. You may withdraw your consent to the FMC holding the information provided in the client questionnaire at any time, by e-mailing info@familymediationcouncil.org.uk
Holding and sharing information
We will use your name to ensure you are eligible for a voucher and to identify your case when corresponding with your mediation provider in order to allocate and pay the voucher funds.
We will anonymise case data and sensitive personal data before using it for research purposes. As the FMC is operating the scheme on behalf of the Ministry of Justice (MoJ) the case data and sensitive personal data will be passed to the MoJ, along with billing information about your case. If you have provided a court reference number to your mediator, the data passed to the MoJ will not be anonymous.
We may transfer and disclose your data to persons acting on our behalf, including contractors who deliver or enable us to carry out the above tasks who will hold, process, transfer and use it on our behalf. These recipients may also process, transfer and disclose to third parties information for the purposes set out above. A list of those who hold your data and act on our behalf can be provided on request. Please e-mail info@familymediationcouncil.org.uk to make such a request.
We will transfer your data to others if obliged to by law.
When we use information for the purposes set out above, we or others acting on our behalf may store the information held electronically in accordance with their privacy notices.
When we share personal data with service providers pursuant to our contractual arrangements with them, we will include appropriate safeguards to protect any personal data that we share with them. The data recipients include, for example, IT service providers and communications providers.
How long we keep information
We keep all information for up to 6 years and 6 months.
Accessing and correcting your information
You can make a written request for a copy of certain personal records we hold about you. In most cases we will not charge a fee; where we do charge a fee, this will be in line with the guidance set out by the Information Commissioner’s Office (ICO) and based on the administrative costs incurred in dealing with the request. We will comply with such a request within a calendar month (with limited exceptions as per the ICO’s guidance), and when provided, the data will be in an open, common format.
If the data we hold is incorrect or incomplete, you can ask for this to be rectified at any time.
Registration with the ICO
The Family Mediation Council is a registered data controller. Its ICO registration number is ZA158086.
In the case of a breach
If a personal data breach occurs, we will record this and consider the likelihood and severity of the resulting risk to your rights and freedoms. If it’s likely that there will be a risk, we will tell you and the ICO within 72 hours:
- the nature of the data concerned, approximately how many people are affected and the consequence of the breach for them; and
- what measures we have taken or plan to take in response.

The FMC may change this Privacy Notice from time to time. Updated Privacy Notices will be published on the FMC’s website.
