This session will help you understand how arbitration works, how it might benefit mediation participants and how to prepare for an arbitration within a mediation setting.

In mediation cases where either the participants really become stuck on an issue, arbitration can help resolve either a single issue or all issues with the continuing assistance of the mediator. Such cases are likely to arise where the mediator has gained the trust of the participants and is preferred as the main organiser of the arbitration rather than the participants’ lawyers and the participants themselves. The session will look at situations where such an opportunity might arise and a summary of how arbitration works. It will also suggest a roadmap for how the mediator might assist the participants in selecting the arbitrator, defining the issues and preparing documentation with of course the input and approval of the participants themselves and their lawyers.

Your speakers
David Emmerson – is a solicitor at Anthony Gold Solicitors in London. He is an accredited, hybrid trained Mediator, Collaborative Practitioner and Deputy District Judge. The majority of his work is mediation and was one of the first to incorporate a private financial dispute resolution within a mediation setting. He is the immediate past Chair of Resolution’s Dispute Resolution committee.
Rhys Taylor is a barrister at 36 Family. He is also an arbitrator. He specialises in non-court dispute resolution and has undertaken a number of arbitrations both as the arbitrator and the advocate. Also a collaboratively trained lawyer and part of Family Procedure Rules Committee working party responsible for the new Part 3 amends and Pre-action Protocol. Rhys is also a Recorder sitting in family cases.
